Paul Sanchez, 31, the man charged in the April 8 deaths of Flora and Chris Chavez of Mountainair, pleaded guilty last Thursday to two counts of vehicular homicide.

 

 

According to Tim Cornish, deputy district attorney in Torrance County, all other charges were thrown out in the plea deal, including aggravated fleeing of a law enforcement officer, possession of a controlled substance, tampering with evidence, driving under the influence of alcohol or drugs, possession of drug paraphernalia, and reckless driving.

The plea deal was accepted by Torrance County District Judge Edmund Kase last week. Sentencing is set for Dec. 3 at 10 a.m. at District Court in Estancia.

Sanchez faces a maximum sentence of 12 years in prison. He pleaded not guilty to all charges at his arraignment on May 14.

Sanchez was arrested April 8 after a truck he was driving collided with a car driven by Flora Chavez in Mountainair, killing her and her 10-year-old grandson, according to the incident report.

Sanchez had a warrant out of Arizona, and sped off after Mountainair Police Chief Edward von Kutzleben pulled him over. Von Kutzleben reportedly shot at the tires of the truck in an attempt to stop him. Sanchez took off through a yield sign and three stop signs, according to the incident report.

Sanchez had been traveling between 54 and 58 mph at the point of impact with the car driven by 78-year-old Flora Chavez, according to State Police investigators. Chavez's car was traveling about 23 to 25 mph. In preliminary hearings, investigators testified no evidence was found that Sanchez had slowed down before the crash.

Sanchez fled on foot after the crash and the chief took him into custody, according to State Police. Witnesses described Sanchez as paranoid and possibly under the influence of drugs or alcohol. Medical responders allegedly found a syringe on Sanchez. After being taken to the University of New Mexico Hospital, Sanchez reportedly attempted to conceal a bag of suspected narcotics, which was tested and confirmed to contain methamphetamine, according to the incident report.

The case has been met with controversy since the incident. Many in Mountainair were angry with von Kutzleben and said he had a part in the deaths of Chavez and her grandson. Von Kutzleben was cleared by State Police investigators soon after the incident, which was caught on tape by the chief's patrol video and audio equipment. Von Kutzleben declined comment on Monday.

Defense attorney Robert Aragon did not immediately return phone calls seeking comment.
